By accessing or using the kTool app or website, including uploading data from tracking devices, you agree to be legally bound by these Terms of Use and our Privacy Policy. If you do not agree with any part of these terms, do not use the app.

kTool is a performance analytics app designed for sailors and coaches. It leverages sensor data collected from onboard and external devices to deliver in-depth sailing analysis, comparisons, and strategic feedback. Services include:

By using the app, you consent to the collection and processing of personal data (full name, email address, boat class or type) and device & sensor data — including GPS coordinates, gyroscope and magnetometer data, wind sensor data, boat speed and heading, heel/roll/pitch angles, acceleration, environmental data, and timestamps and session metadata. This data may be uploaded manually or automatically through connected devices or third-party integrations.

Your data is used to generate personalized analytics, improve the quality and accuracy of our metrics and visualizations, provide support and feature customization, and maintain and enhance the app. We may also use sensor data separated from personal data (anonymized and aggregated) to train and optimize machine learning models, AI-based analytics and new features. 5. Intellectual property

All intellectual property rights related to the app, visualizations, analytics engines, and associated software belong to H B D C Software Solutions DWC-LLC. You retain ownership of the raw data you upload but grant kTool a non-exclusive, royalty-free, worldwide license to use the data (in both personal and anonymized forms) as outlined in this agreement.

6. Subscription and billing

Subscription plans. Access to certain features of the kTool app may require a paid subscription. Plan details, pricing and feature limits are described on our website and/or within the app.

Free use & trials. We may offer free access (such as a limited number of free sessions) and/or a time-limited free trial of paid features. Where a trial requires a payment method, your paid subscription begins automatically when the trial ends and the applicable fee is charged, unless you cancel before the trial period is over. The terms of any current offer are shown at sign-up.

Billing. Subscriptions are billed in advance on a monthly / annual basis and automatically renew unless canceled prior to the renewal date.

Payment processor. Payments are handled securely via third-party processors (e.g. Stripe, Apple/Google in-app purchases). We do not store your full payment details.

Cancellation & refunds. You may cancel your subscription at any time via your account settings or the app store, or by contacting info@ktool.hu. Refunds are generally not provided for unused periods unless required by law.

Price changes. We reserve the right to change subscription prices. If pricing changes, we will notify you in advance. Continued use after price changes indicates acceptance.

7. Disclaimers

The kTool app is currently offered as a beta version. It may contain bugs, incomplete features, or unexpected behavior. By using the beta, you understand that the app is still under development and provided "as is" without guarantees of reliability or performance.

kTool provides performance analysis and sailing insights based on data collected from user devices and sensors. While we strive for high accuracy, all metrics, recommendations and analytical outputs should be considered informational and advisory in nature.

By using the app, you acknowledge that you understand and accept these limitations. The kTool app is provided "as is" and "as available". We do not warrant uninterrupted availability, error-free analytics, or compatibility with all hardware or sensors. Your use of the app is entirely at your own risk.

8. Limitation of liability

To the maximum extent permitted by law, H B D C Software Solutions DWC-LLC shall not be liable for any indirect, incidental, or consequential damages arising from the use of the app or your reliance on its outputs.

9. Changes to these terms

We may update these Terms periodically. If changes are material, we will notify you via email or in-app notification. Continued use of the app after changes indicates acceptance.

10. Governing law

These Terms shall be governed by and construed in accordance with the laws of the European Union and the United Arab Emirates, without regard to conflict of law provisions.
